As the Federal Trade Commission nears a decision on whether to sue Google for antitrust violations, a new company practice has emerged as an example of the search giant's alleged abuse of its market share -- its decision to tilt some search results toward paid advertisers.
Under the new policy, which Google quietly rolled out in mid-October, the company highlights the products of paid advertisers on Google Shopping, its comparison-shopping service, while effectively discriminating against other companies who do not pay to be listed. For example, one company frequently missing in Google Shopping results is Amazon.com.
Analysts said Google's pay-to-play listings are doing online shoppers a disservice.
"I think it's a better system when you include people who should be there and not just people who pay," said Danny Sullivan, editor in chief of Search Engine Land, a website that covers the online search industry. "Amazon is clearly one of the largest merchants not participating and that's a big black eye for Google."
In a statement, a Google spokeswoman said: "Google Shopping makes it easier for shoppers to quickly find what they?re looking for, compare different products and connect with merchants to make a purchase."
On Wednesday, Microsoft published a blog post claiming that holiday shoppers are being ?Scroogled" because Google requires fees to list merchants in the part of its search engine dedicated to shopping results.
"The result of this new 'pay-to-rank' system is that it?s easy for consumers to mistake an ad for an honest search," the blog post said. "That?s not right, it?s misleading."
The blog post was part of a multimedia marketing campaign launched Microsoft that includes television commercials, newspaper advertisements, billboards and a new website, Scroogled.com.
But what the campaign doesn't mention is that Microsoft also favors advertisers with more prominent positions in searches. The company says merchants can get "higher visibility" on Bing Shopping by paying a third-party site, Shopping.com.
Bing director Stefan Weitz said that, unlike Google, Microsoft's shopping search engine lists both paid and unpaid merchants, and doesn't show results based on which one paid.
In coming days, federal regulators are expected to decide whether to sue Google, the creator of the world?s most popular search engine, for antitrust violations.
Major Google rivals, including Microsoft, have argued that FTC action is needed because Google -- which commands 67 percent of the search market -- has the power to play gatekeeper over the Web, directing interested buyers to the sites of companies that have paid to be listed and away from those who refuse to pay.
Google says it's simply trying to improve users search experience by changing its algorithm to show the best results, and has said that "competition is a click away" -- a veiled reference to Microsoft's Bing search engine.
The FTC declined to comment on Wednesday.
While Google's rivals say the company's new fee-based policy shows the need for FTC intervention, Sullivan said Google's new practice might not be evidence that the company is violating antitrust law. Google, he said, could now argue that by accepting payments from merchants, Google Shopping is a collection of ads -- and not a search engine. Such a distinction could potentially help the company avoid antitrust violations.
"Is it a search result or is it an ad?" Sullivan said. "If it's an ad, it doesn't fall into the anticompetitive review that is going on."
Critics say Google's new pay-to-play policy marks a sharp departure from what the company's founders publicly pledged to do when the search giant went public in 2004. In a letter to investors, Google's founders Larry Page and Sergey Brin said Google's search results "are unbiased and objective, and we do not accept payment for them."
"We will live up to our 'don't be evil' principle by keeping user trust and not accepting payment for search results," they said, but added that they "also display advertising, which we work hard to make relevant, and we label it clearly."
Google Shopping discloses that search results are based on merchants who paid them by publishing a "Sponsored" disclaimer over them, though consumers are unlikely to notice. Bing offers no such disclaimer, Sullivan said.
"There's no way for you as a consumer to go to Bing Shopping and know if [a merchant] paid to be listed or did not pay to be listed," he said.
Sullivan said the FTC's guidelines of what constitutes a search engine are unclear and the agency has failed to enforce its rules on how paid advertising on search engines should be disclosed to consumers.
"It?s a perfect example of why the FTC should look at whether consumers understand what they're getting when they use a search engine," Sullivan said, "because the entire space has gotten more complicated and confusing."

Stanislav Volegov, a spokesman for the Federal Penitentiary Service in the Perm region in the Ural Mountains where Maria Alekhina is serving her sentence, said on Rain TV that she was moved into a "safe" cell on Wednesday at her own request.
He didn't spell out the reasons behind the move, but other prison officials said, according to Russian news wires, that Ms. Alekhina made the request because of her perception that fellow prisoners had a negative attitude to her.
Alekhina and two other band members, Nadezhda Tolokonnikova and Yekaterina Samutsevich, were sentenced in August to two years in prison on hooliganism charges for performing a "punk prayer" at Moscow's main cathedral, pleading with Virgin Mary for the deliverance from President Vladimir Putin.

Samutsevich was released on appeal, but Tolokonnikova and Alekhina were sent to prison camps to serve their sentences despite international outrage.

The online Lifenews.ru claimed that Alekhina's inmates threatened her with violence after a heated argument over religion. Prison officials wouldn't confirm that claim, and Alekhina's lawyer, Irina Khrunova, couldn't be reached for comment.
The 20-something Alekhina, a poet and environmentalist, is the mother of a 5-year old boy.

OSLO, Norway (AP) ? Norwegian mass murderer Anders Behring Breivik accused prison officers of trying to drive him to suicide in conditions he describes as "a mini Abu Ghraib."
Breivik wrote a 27-page letter addressed to prison officials, a copy of which was obtained by The Associated Press on Friday.
"If it wasn't for the fact that I am an exceptionally patient person, I would most likely have lost my mind in pure frustration," Breivik said in the letter dated Oct. 15 that was updated on Oct. 26 and Oct. 30. "Anyway, there are limits to what a person can take."
Breivik wrote that he is frustrated that guards do not cooperate with his carefully planned daily schedule, where he times his various activities down to the minute.
"One cannot exclude that Ila Prison's leadership has assured itself that 'loyal social democrats' dominate the ward to prevent possibly benevolent people gaining access," Breivik said. He also alleges that the prison director keeps the security regime tight out of personal vengefulness against Breivik.
The 33-year-old right-wing fanatic killed 77 people in twin attacks last year in Norway's worst peacetime massacre. He detonated a car bomb outside government offices in Oslo killing eight people and then drove to the island of Utoya where he massacred 69 in a shooting spree at the summer camp of the governing Labor Party's youth wing.
Ellen Bjercke, spokeswoman at Ila Prison where Breivik is being held, said the prison had not lifted any security restrictions on Breivik in response to his letter, although he had recently been allowed a normal pen instead of a rubber safety pen, which he had also avidly used during the 10-week trial to make notes.
Breivik said the experience of having to use the stab-free pen was as "an almost indescribable manifestation of sadism."
The self-confessed killer described numerous prison practices as "degrading" in his letter, including that he is watched when swallowing his vitamin pills, that he's not allowed a mop to clean his cell and that he is subjected to daily strip searches, sometimes by female prison guards.
Keeping up his personal hygiene is also a challenge, he said.
"Use of a toothbrush and electric shaver is always under supervision. One is therefore under mental pressure to finish quickly as the guards are tapping their feet outside the cell ... This limits brushing to once a day and shaving to once a week in order not to have to go through the mental ordeal more often than necessary," he wrote in the letter.
"Therefore there is the likelihood that Norway's own 'mini Abu Ghraib,' in the cellars of Ila Prison, are being kept a secret and that Norway's human rights ambassadors' work to spread the 'world's most humane principles' are avoiding being embarrassed."
Breivik was referring to a prison in Iraq that became notorious in 2004, when photos were released of detainees being abused by U.S. soldiers.
In a handwritten note sent with the 27-page typewritten letter, Breivik said he had sent copies of it to the AP, the International Press Center in Oslo, select Norwegian media and Amnesty International.
Bjercke said that Breivik was given an electric typewriter earlier this month but that it was not connected to his letter of complaint.
During his pre-trial detention he was allowed a computer that could not be connected to the Internet, but it was taken away from him when he started serving his sentence.
The Oslo District Court found Breivik guilty of terrorism and premeditated murder for the July 22, 2011 attacks. He was given a 21-year prison sentence that can be extended if he's considered a threat.
The self-styled anti-Muslim militant denied criminal guilt, saying he's a commander of a resistance movement aiming to overthrow European governments and replace them with "patriotic" regimes that will deport Muslim immigrants. Police said they found no evidence of Breivik belonging to any such group.

Earlier this week, the Community Foundation of the Ozarks awarded $50,000 in grants as part of its Metro Springfield Early Childhood grant program.
They were awarded to programs that address the ?red flags? related to early childhood issues identified by the Community Focus Report for Springfield-Greene County, according to a news release.
They included:
?Friends of Operation US: $9,200 for materials to support the Hatching Project, to provide strategies to reduce abuse and neglect of young children.
?Ozarks Literacy Council: $4,000 for materials to improve Kindergarten readiness though pre-literacy training and tutoring.
?University Child Care Center: $2,000 for teacher training and materials to support the Project Construct learning model.
?Ozarks Area Community Action Corporation Head Start: $13,750 to improve early childhood education and Kindergarten readiness through the use of DIAL-4 diagnostic kits.
?Community Partnership of the Ozarks: $8,000 for the Strengthening Families Program to help families internalize protective factors that lessen child abuse.
?Lighthouse Child and Family Development: $6,000 for materials and training to provide case management, family education and quality child care at low cost for high-need families.

No sooner does Apple released the iPhone 5 than HTC and Verizon escalate with the Droid DNA. Where the iPhone 5 is slim and sophisticated, the Droid DNA is big and brutally powerful. Where Apple is anodized aluminum, HTC is soft-touch polycarbonate. Where iOS is consistent across all Apple's mobile products, HTC Sense changes up the Android interface for good or for ill. From atom to bit, the iPhone 5 and the Droid DNA couldn't be more different. So if you're looking for a new phone on Verizon, how do you choose between them?
The HTC Droid is huge. It's not part tablet, part phone, if such things concern you, but with a 5-inch screen, it's about as big as a phone can get. What's more, that 5-inch screen houses and incredible 1920x1080 (1080p) screen at a retina-rupturing 440ppi. It's the biggest, densest display on the market today. However, all that screen-power is being driven by the same Snapdragon S4 Pro horse-power that drives other, much smaller displays, like the 720p Nexus 4. HiDPI comes at a performance price, after all. The cameras are both excellent, with an 8 megapixel f/2.0, 1080p sensor with BSI on the back, and a 2.1 megapixel, 1080p sensor, also with BSI, on the front. The bad news is that the battery is only 2020mAh, which some will find acceptable and others won't, and Verizon is only offering the Droid DNA with 16GB, no more. And that's not a lot of space when you're dealing with 1080p.
The Droid DNA shops with Android 4.1.1 Jelly Bean, but should get an Android 4.2 update at some point. As usual with HTC devices, instead of the stock Google experience, you get the Sense interface, in this case, Sense 4+. You get 5 Home screens, adorned, of course, with the iconic HTC clock. You've also got a suite of Amazon media apps, whose streaming capabilities should help reduce the burden on the 16GB of storage (technically 11GB once the OS and apps are factored in), and a few other pre-installed apps, courtesy of Verizon.
In the Verizon Droid DNA review, Phil Nickinson of Android Central summed it up like this:
The simple fact is this: Alongside the Samsung Galaxy S3, the HTC Droid DNA is the best Android phone you can get on Verizon. Display, power, camera, and it's running Jelly Bean out of the box. What more do you need?
In the U.S., the Droid DNA is exclusive to Verizon, though versions of the same basic phone, with different names, will likely show up on different networks, especially internationally, at some point.
The iPhone 5 has a completely re-engineered unibody aluminum chassis to allow for a bigger 4-inch screen in a phone that's 12% smaller by volume. It's taller but not wider, thinner and also lighter. That 4-inch screen uses in-cell technology to combine the touch sensor right into the LCD so the pixels look painted on. At 1136x640 and 326ppi, it's still backlit LED, and still IPS, and while nowhere near the biggest, it's still one of the most advanced panels on the market. Apple also rolled their own, manually-set Apple A6 processor this time, based on ARM v7s, for high performance and excellent power management.There is CDMA, HSPA, and international LTE. And you can get it in 16GB, 32GB, and 64GB versions. There's still no NFC or wireless charging, however.
iOS 6 comes loaded on the iPhone 5, and includes a new, controversial Maps app, some great extensions to Apple's virtual assistant, Siri, deep Facebook integration, Passbook for tickets and vouchers, and enhancements to FaceTime, Mail, Safari, Photo Stream, Panorama, and Accessibility. And because Apple makes both the hardware and the software, there's no integration cost, no added interface layers, and a seamless experience overall.
iTunes has the biggest international content footprint, so if you're into buying your music, TV, and movies, there's a better chance Apple will take your money than anyone else. They also have the free iCloud service for backup, restore, and sync, as well as Apple Retail Stores with Genius Bars which, if you ever break your phone, you'll absolutely consider a killer service.
In the iPhone 5 review, I summed it up as follows:
Taller, thinner, faster, lighter, brighter; the iPhone 5 represents nothing more nor less than the latest, relentless iteration on the Platonic ideal Apple has been striving towards for almost a decade. Redesigned in every way but shape, compromised but true to its purpose, the iPhone 5 is once again the best iPhone Apple has ever made, and one of the best phones ever made. Period.
The price on-contract price for an iPhone 5 is $199 for 16GB, $299 for 32GB, and $399 for 64GB, unlocked and off-contract is $650, $750, and $850 respectively.
The Droid DNA has absolutely the biggest, sharpest screen on the market, and if pure pixel density is your measure, the best one too. HTC Sense is a mixed blessing -- some love it, others hate it. Like the Verizon crap-ware that comes pre-installed, however, you'll have to root and flash a different ROM, like Cyanogen, to get an experience that's closer to stock. Also, while Android Central didn't encounter major battery or performance issues, other reviews have found them problematic (but then, the same could be said about the iPhone.) 16GB of storage is anemic, however, no matter how you slice it. Still, but for that, and from a pure tech and spec perspective, the Droid DNA is arguably the baddest ass Android phone on the planet now. And if you're on Verizon, or willing to switch to Verizon, and don't want an iPhone, it really looks like the phone to beat.
The iPhone 5 manages to fit a 4-inch screen into a phone that's ludicrously thin and light, and built like nothing else on the market. iOS 6 is iOS 6 on every iPhone that supports it, so there's no third-party layer on top of the core operating system. That's either a plus or a negative, depending on how you feel about iOS. There's also no crap-ware, however, and no carrier pre-installed anything. There's also 32GB and 64GB options if you want to store more apps and media on your iPhone. And you can get the iPhone 5 -- the same iPhone 5 -- on almost any carrier you choose. You can also get iTunes content in more countries than any other media store, and Apple Retail provides the best customer care in the business.
If you're on Verizon and want an LTE phone, and the even the idea of 1080p display sends you heart racing, get the HTC Droid DNA. Otherwise, for most people, most of the time, the cliche remains true -- get the iPhone.

ScienceDaily (Nov. 22, 2012) ? Women who have undergone group therapy and learned to relax have reduced their menopausal troubles by half, according to results of a study at Link?ping University and Link?ping University Hospital in Sweden.
Seven out of every ten women undergoing menopause have at some point experienced problems with hot flushes and sweating. For one in ten women, the problems lasted five years or longer, primarily causing discomfort in social situations and insomnia.
The background to this is not known. What is known is that the decreasing amounts of the female hormone estrogen -- which occurs after menopause -- affects the brain's heat regulation centre in the hypothalamus.
Medication with estrogen has proven to have a good effect. At the end of the 1990s, Swedish doctors prescribed hormone tablets to around 40% of women with moderate to severe symptoms. But since new observations have shown that the treatment increased the risk of breast cancer and cardiovascular disease, their use has decreased drastically. Today, the number of women with menopausal problems receiving estrogen is down to 10%.
The situation triggered an interest in alternative forms of treatment. For her doctoral thesis, Women's Clinic consultant Elizabeth Nedstrand arranged a study where a group of women were randomly assigned to three different treatments alongside estrogen: acupuncture, exercise, and applied relaxation -- a method based on cognitive behaviour therapy developed by psychologist Lars-G?ran ?st.
The results were so interesting that a larger randomised study around the effects of applied relaxation began n in 2007. 60 women who saw a doctor for moderate to severe symptoms occurring at least 50 times a week -- but who were otherwise completely healthy -- were randomly assigned to two groups: one had ten sessions of group therapy and the other received no treatment whatsoever. The results are now being published by Nedstrand and Lotta Lindh-?strand in the scientific journal Menopause.
Nedstrand herself conducted the therapy, which is based on learning to find the muscle groups in one's body and getting the body to relax with the help of breathing techniques.
"The participants were given exercises to practice daily at home. The goal was for them to learn to use the method on their own and to be able to manage their own symptoms.
During the intervention period and for three months thereafter, the women kept a diary of their hot flushes. They also had to fill out a "quality of life" survey on three occasions, in addition to submitting a saliva sample for analysis of the stress hormone cortisol.
The results were striking. The women in the treatment group reduced the number of hot flushes per day from an average of 9.1 to 4.4; the effect remained for three months after the last therapy session. The numbers in the control group also decreased, but only from 9.7 to 7.8.
The women in the therapy group also reported improved quality of life as regards memory and concentration, sleep, and anxiety. On the other hand, there were no statistically significant differences in stress hormone secretion.
"The study confirms that applied relaxation can help women with menopausal troubles. My hope is that women can be offered this treatment in primary care and from private health care providers," Nedstrand says.

TORONTO (Reuters) - Canada's main stock index climbed to a more than one-week high on Thursday as Research In Motion Ltd
The market was also supported by data that showed China's manufacturing sector was picking up steam, a sign of increased demand for Canadian resources.
Research In Motion was up 17.3 percent at C$12.00 after National Bank Financial raised its price target on the stock to $15, citing "positive sentiment building in the industry" ahead of the launch of the company's BlackBerry 10 devices.
The stock played the second-biggest role of any single company in leading the market higher. It was the stock's biggest one-day gain since April 2009.
"The dominant news today is the performance of RIM," said John Ing, president of Maison Placements Canada. "The company has had nothing but bad news over the past year, and the stock has been oversold."
The Toronto Stock Exchange's S&P/TSX composite index <.gsptse> ended higher for a fifth straight session. It closed up 53.04 points, or 0.44 percent, at 12,153.10. Earlier in the session, it hit 12,171.20, its highest level since November 13. All 10 main sectors were positive.
Volumes were lighter than usual due to the U.S. Thanksgiving holiday, which closed stock markets there. About 124 million shares changed hands on the Toronto Stock Exchange, compared with a daily average of 281.9 million in October.
The financial sector also edged up for a fifth day, rising 0.3 percent ahead of the quarterly reporting season for Canadian banks, which starts next week.
Expectations for solid results and possible dividend increases at some of the banks have been fueling the sector, said Allan Small, senior investment advisor at DundeeWealth Inc.
"(Canadian banks) are still relatively cheap when you look at where they are trading on a multiple basis. There is definitely some value there," he said.

Today is my third birthday and, after a month of having major mental health issues, I am determined to have a good time.
